The purchase conditions are governed by the provisions of the Consumer Code (Legislative Decree 206/2005), while the protection of privacy (privacy) is governed by the provisions of Legislative Decree 196/2003.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL SALES CONDITIONS

PRICES

3.1 All the prices shown on the Site are expressed in Euro and are inclusive of VAT. The prices of products from time to time published on www.lucianomaggi.com cancel and replace the previous ones and are subject to the actual availability of the products.
3.2 The guaranteed price to the buyer is the one published on the site at the time the order is sent, without any consideration of any price changes that occurred subsequently or previously.
3.3 The customer is responsible for the choice of the products ordered and for the compliance and conformity of the specifications indicated by each manufacturer to their needs.

PRODUCT FEATURES

4.2 The images and colors of the products published on the site may differ from the real ones due to the local settings of the systems and / or tools used for their display. In case of cancellation of the order, both by the Customer and in the case of non-acceptance by Luciano Maggi, the amount will be refunded to the Customer’s PayPal account.
Once the cancellation of the transaction has been requested, in no case shall Luciano Maggi be held liable for any damages, direct or indirect, caused by delay in the non-release of the amount committed by PayPal. At no time during the purchase process Luciano Maggi is able to know the customer’s financial information. Since there is no data transmission, there is no possibility that these data are intercepted. No computer archive of Luciano Maggi contains, or retains, such data. WARRANTY

6.1. All products sold by Luciano Maggi through the site www.lucianomaggi.com, are covered by the manufacturer’s standard warranty and 24-month warranty for lack of conformity, pursuant to Legislative Decree 24/02. To use the warranty, the Customer must keep the invoice (or DDT) he will receive via e-mail in PDF electronic format.
6.2 The exercise of the Guarantee may include the request for assistance to the Authorized Assistance Centers present in the area and / or follow the methods illustrated in the documentation included in the product packaging.
6.2 The manufacturer’s standard warranty is provided in the manner described in the documentation included in the product packaging. If, as a result of intervention by an Authorized Service Center, the defect is not covered by the manufacturer’s standard warranty, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as transport costs, if supported by Luciano Maggi.
6.3 The 24-month warranty pursuant to Legislative Decree 24/02 applies to products that present a lack of conformity, provided that the product itself is used correctly, respecting its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who buys goods for purposes not related to his professional activity, or makes a purchase without indicating a VAT number in the order form). In the event of a lack of conformity, Luciano Maggi will, at no cost to the Customer, restore the product to conformity by repair / replacement or price reduction, until the contract is terminated. If, following an intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and recovery required by the Authorized Assistance, as well as the transport costs if supported by Luciano Maggi.
Replacements in case of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided by the manufacturer. The timing of replacement or repair of the product depends exclusively on the policies of the manufacturer.

6.4 In the event that, for any reason, Luciano Maggi is unable to provide his customer with a product under warranty (restored or replaced), he may at his discretion return the amount paid, taking into account the use of the asset. or to replace it with a product of equal or superior characteristics.
6.5 The time required to repair or replace the product depends exclusively on the policies of the manufacturer and no damage can be requested from Luciano Maggi for any delays in repairs or replacements.
6.6. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend inserting it in a second box; in all cases, the attachment of labels or adhesive tapes directly to the original product packaging should be avoided.
6.7 The customer will be provided with a return authorization number (RMA) which must be indicated outside the packaging, following the instructions provided directly in the relevant authorization e-mail.

TERMS AND DELIVERY COSTS

7.1. For every order placed on www.lucianomaggi.com, luciano maggi may issue an invoice for the material shipped upon specific customer request. If the invoice is necessary, the customer is required to communicate it during the purchase process, indicating on the order form or by email at: info@lucianomaggi.com the VAT number and / or Tax Code. (DL N. 633/72 ART. 22 OF THE D.p.)
7.2 To calculate the shipping costs the customer must enter the products he intends to purchase in the cart and specify the delivery CAP to obtain the automatic calculation of the system based on the rates entered, or contact customer support: info@lucianomaggi.com for a personalized quote.
7.3. For deliveries to European Union and international countries, the shipping fee is indicated on the confirmation page at the time of the order. Customs duties and taxes related to the country where the delivery will take place are the responsibility of the buyer.

SHIPMENT

8.1. The times of availability and delivery of the ordered Products are specified in the product sheet and are those provided by the manufacturers. Luciano Maggi cannot be held responsible for delays in delivery attributable to the manufacturer
8.2. The shipment of the ordered products is normally carried out through affiliated couriers BARTOLINI, SDA, FERCAM SPA depending on whether the service chosen is Standard or Express. Luciano Maggi has the right, at its sole discretion, to deliver the products ordered by a different courier from the aforementioned.
8.3. The delivery of the ordered is meant at street level.
No delivery to the plan and / or special pores is foreseen. Should the Customer need such extra services, he must request a specific quote from Luciano Mardi by sending an e-mail message and specifying the characteristics of the requested service.
8.4. Upon delivery of the goods by the courier, the Customer is required to check:
. that the number of packages delivered corresponds to what is indicated in the transport document in advance by e-mail;
. that the packaging is intact, not damaged or wet or otherwise altered, even in the closing materials (adhesive tape or metal straps).
Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately contested, affixing a WRITTEN CONTROL RESERVE (SPECIFYING THE REASON FOR THE RESERVE, eg “punched packaging”, “crushed packaging” , etc.) on the courier delivery proof.
8.5 Once the courier’s document has been signed, the Customer will not be able to make any objection regarding the external characteristics of the delivered item.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set forth in this document.
8.6. In the event of non-collection within 5 working days of the material in storage at the courier’s warehouses due to repeated inability to deliver to the address indicated by the Customer when the order is placed, the order will be returned to the warehouses of Luciano Maggi

RIGHT OF WITHDRAWAL

9.1 According to the art. 5 DL 185/1999, if the customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase indicating in the order form to Luciano maggi a reference to VAT number ), has the right to terminate the purchase contract for any reason, without need to provide explanations and without any penalty, except as indicated in paragraphs 9.4 and 9.9 below

9.2 To exercise this right, the customer will have to send a communication to that effect to luciano maggi within 14 working days of receipt of the goods. This communication must be sent by email to the address info@lucianomaggi.com within the aforementioned terms

9.3 Once we have received the aforementioned withdrawal notice, the Luciano MAY Customer Service will promptly notify the customer of the instructions on how to return, assigning a unique RMA code for the return of the goods, which must reach Luciano Maggi within 10 days from ‘authorization.
The goods must be returned intact, complete with all its parts and in the original packaging (envelopes and packaging), kept and absolutely sealed.

9.4 The right of withdrawal is in any case subject to the following conditions:
the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased;
the purchased good must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend inserting it in a second box, on which to affix the label, bearing the RMA number (return authorization code); in all cases, the attachment of labels or adhesive tapes directly to the original product packaging should be avoided;
9.5 by law, the shipping costs for returning the goods are charged to the customer; furthermore, the delivery costs to the customer and any other accessory costs highlighted at the time of the order will not be reimbursed;

9.6 the shipment, until the certificate of receipt in our warehouse is under the complete responsibility of the customer; in the event of damage to the goods during transport, luciano maggi will notify the customer of what happened (within 5 working days from receipt of the goods in its warehouses), to allow him to file a timely complaint against the courier chosen by him and obtain a refund of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;
9.7 Luciano Maggi is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments; on arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged or opened, Luciano Maggi will deduct from the refund due a percentage, in any case not exceeding 20% ​​of the same, as a contribution to the restoration costs.

9.8 Without prejudice to any repair costs for damage to the original packaging, Luciano Maggi will reimburse the customer the full amount already paid, within 14 days of the return of the goods, by transferring the amount charged to the credit card or by bank transfer. In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the reimbursement (Cod. ABI – CAB – IBAN – Current Account of the invoice holder).

9.9. The right of withdrawal is lost for lack of the essential condition of integrity of the good (packaging and / or its content), in cases where Luciano Maggi ascertains:
use of the good or opening of the original packaging;
lack of external and / or internal packaging;
the absence of integral elements of the product (accessories, manuals);
damage to the product for reasons other than transportation.
In case of forfeiture of the right of withdrawal, the goods will remain at the headquarters of Luciano Maggi, available to the customer for collection at your expense.

PROCESSING OF PERSONAL DATA

Luciano Maggi pursuant to art. 13 of Legislative Decree 196/2003 informs that personal data, personal and fiscal data acquired also verbally with reference to established commercial relationships, provided directly by the interested parties, will be processed in compliance with the law referred to and for the purposes mentioned above, including the obligations of confidentiality provided by these. JURISDICTION

This contract is subject to Italian jurisdiction. The present general conditions, although not expressly provided for, are referred to the rules on purchase contacts stipulated at a distance (in the case of distance contracts through computer network) of the civil code, of the legislative decree 185 / 1999, of Legislative Decree 70/2003 and Legislative Decree 206/2005. Any dispute concerning the application, execution, interpretation and termination of this contract will be referred to the exclusive jurisdiction of the Court of Florence
